Rules of Arbitration
The arbitral proceedings are similar to an ordinary state court’s proceedings. However, the Arbitral Tribunal for the Swiss Real Estate Industry does not apply procedural rules uniformly addressing all sort of courts but considers provisions suitable to the needs of the real estate industry.

Moreover, tight procedural settings that allow an efficient dispute resolution and the high level of discretion missing in ordinary state courts’ procedure due to the principle of public trial are further valuable features of the arbitral proceedings.

The Rules of Arbitration for the Swiss Real Estate Industry has been in force since January 1, 2005 and may be chosen by all national and international participants in the Swiss real estate industry. The parties may have only to include an arbitration clause (Model Arbitration Clause) in the related contracts or to stipulate the application of the Rules of Arbitration after the dispute emerged.
